End User License Agreement (EULA)

Note: This End User License Agreement is between you and VHN Group (Rémi Vanhaelewyn), not Apple Inc. Apple is not responsible for the Vera application or its content.

1. Parties

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Rémi Vanhaelewyn – VHN Group ("Licensor"), located at 60 rue François 1er, 75008 Paris, France, for the use of the Vera mobile application ("Application").

2. License Grant

Subject to the terms of this EULA and payment of applicable subscription fees, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.

3. Restrictions

You may not:

Copy, modify, or distribute the Application
Reverse engineer, decompile, or disassemble the Application
Rent, lease, or lend the Application to third parties
Use the Application for any illegal purpose or in violation of any applicable law
Remove or alter any proprietary notices or labels on the Application

4. Subscription and Payment

Free Trial: 7 days at no charge
Subscription: €7.00 per month after the trial period
Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
Payment is charged to your Apple ID account at confirmation of purchase
You may manage and cancel your subscription in your App Store Account Settings

5. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE LICENSOR DOES NOT WARRANT THAT THE APPLICATION WILL BE ERROR-FREE OR THAT IT WILL ACCURATELY DETECT ALL NON-SPONTANEOUS VOICES. THE SCORES PROVIDED ARE PROBABILISTIC INDICATORS ONLY.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APPLICATION. THE LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APPLICATION IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Privacy

Your use of the Application is subject to our Privacy Policy, available at:
veraapp.io/privacy

Vera does not record or store any audio data. Analysis is performed in real-time and audio is immediately discarded after processing.

8. Apple-Specific Terms

You acknowledge and agree that:

This EULA is between you and the Licensor only, and not with Apple Inc.
Apple has no obligation to provide maintenance or support for the Application
Apple is not responsible for addressing any claims relating to the Application
In the event of any third-party claim that the Application infringes intellectual property rights, Apple will not be responsible for the investigation or settlement of such claims
Apple and its subsidiaries are third-party beneficiaries of this EULA

9. Governing Law

This EULA shall be governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer protection laws of your country of residence provide otherwise.

10. Consumer Rights (EU)

If you are an EU consumer, you benefit from mandatory provisions of the law of your country of residence. Nothing in this EULA affects your rights as a consumer under applicable EU consumer protection laws, including your right to withdraw from a distance contract within 14 days.
